Welcome to MadeByDJs. By using our website and services, you agree to be bound by the following terms and conditions. Please read them carefully. You must be at least 18 years old or have parental consent to make a purchase.

1. Product Customization

You are responsible for the information you provide for your custom product.

• Customer Responsibility: You are responsible for providing accurate and complete customization details through our forms. MadeByDJs is not liable for errors such as typos or incorrect data. While we make reasonable efforts to flag obvious errors before production, we cannot guarantee detection.
• QR Code and Tap-Connect Links: You are responsible for ensuring your provided QR code link is accurate and functional. For your security, we strongly recommend using an HTTPS link. MadeByDJs is not responsible for errors in the link or the content of the linked website. If you provide an insecure link (http://), you accept all liability for any issues that may arise.
• Mockups and Customization: Custom mockups and additional customizations are available upon request and may involve extra charges. Production begins only after you approve the final design.
• Estimated Production Time: We aim to produce and ship most orders within 2–3 business days. More complex custom orders or high-volume periods may require 5–7 business days. This is an estimate, not a guarantee, and does not include shipping transit time.
• Content Restrictions: You must not submit any content that is unlawful, harmful, threatening, or otherwise objectionable, including but not limited to hate speech, explicit imagery, or copyright violations. MadeByDJs reserves the right to refuse orders containing such content at its sole discretion.
• Replacements: If a replacement is needed due to your error, you will be invoiced for the full cost of materials, labor, and shipping. Replacements are provided at the sole discretion of MadeByDJs.

2. Shipping & Fulfillment

• Production Time: Most orders are produced within 3 business days.
• Shipping Services: We ship via USPS or other carriers. All transit times provided are estimates directly from the carrier and are not guaranteed by MadeByDJs. We are not responsible for carrier-related delays. Faster shipping speeds are available upon request at an additional cost.
• Address Accuracy: You must provide a correct and complete shipping address. We are not responsible for delays or failed deliveries caused by an incorrect address.
• Tracking: You will receive a tracking number once your order has been dispatched.
• Damaged Orders: A "damaged" order is defined as a product with a structural defect or missing parts that occurred during shipping. To be eligible for a free replacement, you must provide photo evidence of both the damaged product and the original packaging within 7 days of delivery.

• Lost or Stolen Packages: If your package is marked as delivered but you have not received it, MadeByDJs will file a claim with the USPS on your behalf. We will provide a free replacement if the USPS claim is successful. If the USPS claim is unsuccessful, we will offer you a replacement at a discounted rate, covering only our direct costs for materials and shipping. You agree to cooperate fully with MadeByDJs and the USPS throughout this claims process. This includes responding to all communications and providing any necessary information or proof within a reasonable timeframe (e.g., 5 business days). If the carrier fails to resolve the claim within 30 days, we will offer a discretionary solution, which may include a store credit or a replacement at a discounted rate. MadeByDJs is not responsible for packages lost due to an incorrect or incomplete shipping address provided by the customer.

3. Satisfaction Guarantee & Returns

Due to the custom nature of our products, all sales are final. We do not offer returns or refunds on products that were produced correctly based on the customization information provided. Nothing in these Terms limits your non-waivable statutory rights. However, we are committed to your satisfaction:

• Quality Control: MadeByDJs' products undergo a rigorous quality control process to ensure they are free of structural defects and functional flaws.
• Defective Product: A product is considered defective if it has a significant structural or functional flaw that prevents the product from being used as intended (e.g., a cracked base, a damaged QR code). Minor cosmetic imperfections, such as small surface scratches or slight variations in print color, may not be considered defects. While we test all NFC chips for functionality prior to shipping, we cannot guarantee their compatibility with every mobile device and software version. Please note that NFC compatibility can be device-dependent. Issues with NFC functionality on a specific device may not be considered a product defect.

4. Intellectual Property

• 4.1. MadeByDJs' Property: All designs and assets created by MadeByDJs are our exclusive intellectual property. These materials are not to be reproduced or distributed without our explicit written consent.

5. Privacy Policy

MadeByDJs is committed to protecting your privacy. This policy outlines how we handle your personal information.

• Information Collected: We collect essential information required to fulfill your order, including your name, shipping address, email address, phone number, and order details (custom text, QR code URL).
• Use of Information: This information is used for the sole purpose of processing, customizing, and delivering your product, as well as for communicating with you about your order. We also use your email address for marketing communications if you have opted in.
• Data Security: We implement reasonable security measures to protect your personal information. However, no method of transmission over the Internet or electronic storage is 100% secure.
• Payment Security: All payment transactions are handled securely by our third-party payment processor, Stripe. We do not store or have access to your credit card or other payment details.
• Data Sharing: We do not sell, trade, or otherwise transfer your personal information to outside parties. Your data may be shared with trusted third parties, such as our shipping partners, only to the extent necessary to deliver your product.
• Data Retention: We will retain your personal information for as long as necessary to fulfill the purposes outlined in this policy, or as required by law.
• Your Rights: You have the right to access, correct, or delete your personal information. Please contact us to make a request. Depending on your location (e.g., California), you may have additional rights.

6. Dispute Resolution & Chargeback Policy

If you have an issue with your order, you agree to contact us at support@madebydjs.vip to seek a resolution before initiating a chargeback. You agree to participate in good faith in this informal resolution process for a period of at least 15 business days.

Filing a chargeback without first completing this informal resolution process may be considered a breach of this agreement. We reserve the right to contest any chargeback and provide evidence of this agreement to the relevant financial institution. Customers who file fraudulent chargebacks may be barred from future purchases.

7. Limitation of Liability

MadeByDJs is not liable for any indirect, incidental, or consequential damages arising from the use of its products or services. In all cases, our total liability is limited to the greater of (i) $100 or (ii) the amount paid for the specific order giving rise to the claim. This limitation does not apply to liability for personal injury, fraud, or gross negligence.

The website and all services are provided on an "as is" and "as available" basis without any warranties of any kind.

8. Governing Law & Mandatory Arbitration

These Terms are governed by the laws of the State of Minnesota. Except for matters that can be taken to small claims court, any dispute arising from these Terms or our products must be resolved through final and binding arbitration.

The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. A copy of these rules is available at www.adr.org. You and MadeByDJs agree that all proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. By agreeing to these terms, you and MadeByDJs are each waiving the right to a trial by jury or to participate in a class action.

You may opt out of this arbitration agreement by sending us written notice of your intent to do so within 30 days of your first purchase. This opt-out notice must be sent to support@madebydjs.vip or to our physical address at 29442 120th St, Grey Eagle, MN 56336. The notice must include your name, address, and a clear statement of your intent to opt-out. If any part of this arbitration clause is found to be unenforceable, the remainder of the clause shall remain in effect.

9. Changes to Terms

We reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting to our website. Changes will not affect orders placed before the effective date of the change, which will be governed by the Terms in effect at that time. Your continued use of our site after changes are posted constitutes your acceptance of the new Terms.

10. Entire Agreement

These Terms of Service, along with any other policies referenced herein, constitute the entire agreement between MadeByDJs and you. This agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and MadeByDJs.

12. General Legal Terms

Force Majeure: MadeByDJs shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by an event beyond our reasonable control.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent.
